WEST POINT, Miss.–It was an overdose of codeine that killed two-year-old Brinson Smith back in April and now the mom charged with giving the child too much medicine says she wants out of jail on bail.
Its back problems that Brittania Smith told the judge she’s dealing with during her stay at the Clay County lock-up. Her attorney, Jim Waide, has told the judge that the county jail doesn’t have the resources to handle Smith’s incarceration.
The judge has set a July 2 date for a hearing to consider it.
Smith is charged with capital murder.
