HATTIESBURG, Miss. — The death sentence has been thrown out for Roger Gillett. He was convicted back in 2007 for his role in the murder of a Hattiesburg couple and transporting their bodies to Kansas in a freezer. Gillett also tried to escape after he was arrested in Kansas which is was one of the factors that played into jurors supporting the death penalty.
It 6 to 3 vote from the Miss. Supreme Court for re-sentencing Thursday. They said not every escape is considered a violent crime in Kansas and a crime committed out of state cannot be used to support a Mississippi death sentence.
