The man accused of slaying former Ole Miss student Jimmie ‘Jay’ Lee will stay behind bars until his day in court.
Sheldon Timothy Herrington, Jr. appeared at the Lafayette County Courthouse in Oxford for a bond hearing Thursday. Herrington was denied bond for a tampering with evidence charge that was levied after Lee’s remains were found in Carroll County earlier this month. The hunters discovered the body, which was confirmed to be Lee’s after DNA testing, while hunting during an extended deer season window.
Herrington’s attorney, Aafram Sellers, filed a motion to dismiss the tampering with evidence on February 18, citing state of limitation concerns, but the motion was denied.
The bond denial is the latest in what has become a winding legal saga after Herrington was accused of murdering Jimmie ‘Jay’ Lee to allegedly cover up a romantic relationship the two were having.
A mistrial was declared in December after the jury failed to reach a consensus on whether to charge Herrington with capital murder, first-degree, second-degree murder, culpable negligence manslaughter, or find him not guilty. An 11-1 vote favored conviction, but the lone dissenting vote required new proceedings.
The date for a retrial has not been set by Circuit Judge Kelly Luther.
