FLORENCE, Miss. – A man from Florence has been charged with aggravated assault after deputies say he shot a man that crossed over onto his property over the weekend. Evidently, Thomas Presley had permission from one property owner to fish on a pond which was also shared by Cregg Puckett.
When Presley crossed onto Puckett’s property line, Puckett shot him in the in the wrist, hand, and butt. Monday, Presley was still recovering at the hospital.
According to Mississippi College Law Professor Matt Steffey, it is not likely that Puckett will be able to argue the Mississippi’s Castle Doctrine Law in his defense.
“You don’t have the right to shoot trespassers,” said Steffey. “The castled doctrine is the right to use defense force, you must defending against a felony on your person, your home, your car or your place of business and there is nothing in the facts that indicate any of that.”
