Daniela Vargas was a standout student and trumpet player at Morton High School. Her studies at Southern Miss were cut short due to financial troubles, and now that may be the case for her time here in the United States.
Vargas was 7 years old when she and her parents moved from Argentina to America. She applied for, and was granted DACA (Deferred Action for Childhood Arrivals) status. Vargas was unable to pay the $495 filing fee renew her latest status which expired in November of last year. After being detained for what Immigration and Commerce Enforcement are treating as a “visa overstay,” Attorney Abigail Peterson is asking ICE to consider sending Vargas’ case to a judge for a hearing. Otherwise, Vargas could be deported in as little as two weeks.
There is a catch with signing a visa to enter the U.S.: those who sign agree to forgo their right to a hearing if they let their visa expire. Attorneys say this case hinges on the fact that Vargas was too young to sign the waiver.
