JACKSON, Miss.- In 2000, Marlon Howell, 36, was convicted of capitol murder and sentenced to death row. He has been trying to get a new trial ever since.
Howell was charged with the capital murder of David Pernell, a Northeast Mississippi Daily Journal carrier in New Albany. The murder happened during a robbery in 2000.
Howell explains that new alibi witnesses could bring information important to the case that would require a new trial. One of the witnesses, Lasonja Gambles, gave a sworn statement claiming she drove Howell to Blue Mountain from New Albany hours before the murder happened.
The Mississippi Supreme Court has again denied Howell’s request for a new trial, stating Howell’s attorney could have easily had Gambles testify in the original trial.
